These Terms of Service (“Terms”) govern your use of the website alphory.com and the early-access waitlist (together, the “Service”) provided by Atarax GmbH, Görgengasse 25, 1190 Vienna, Austria (“Alphory”, “we”, “us”). By using the Service you agree to these Terms.

1. The Service

The Website presents information about Alphory, a planned AI-assistant product, and lets you register your interest via an early-access waitlist. Access to the product itself is not guaranteed by joining the waitlist and may be subject to separate terms when it becomes available.

2. Early access

Joining the waitlist is free and non-binding. We may contact you about availability and, where relevant, about pricing and features. Any paid plans will be presented clearly and will require your explicit consent before any charge.

3. Acceptable use

You agree not to misuse the Service, including by attempting to disrupt it, gain unauthorized access, or use it for unlawful purposes. We may restrict access where use violates these Terms or applicable law.

4. Intellectual property

The Alphory name, logo, content and design are owned by Atarax GmbH and protected by applicable law. These Terms do not grant you any right to use our trademarks or content except as necessary to use the Website as intended.

5. No warranty

The Website is provided “as is” and “as available”. To the extent permitted by law, we make no warranties regarding availability, accuracy or fitness for a particular purpose.

6. Limitation of liability

To the extent permitted by applicable law, Atarax GmbH is not liable for indirect or consequential damages arising from your use of the Website. Statutory liability for intent and gross negligence, and mandatory consumer-protection rights, remain unaffected.

7. Changes

We may update these Terms from time to time. The current version is always available on this page. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

8. Governing law

These Terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer-protection provisions of your country of residence remain unaffected.
